Agreement to Terms

By engaging Orca Pools WA (“we”, “us”, “Josh Stokes”) for any services, or by using this website, you agree to these Terms of Service. If you do not agree, please do not engage our services.

Services

Orca Pools WA provides pool equipment repairs, green pool recovery, heating and automation installation, and related maintenance services across Perth, Western Australia. All services are performed personally by Josh Stokes or under his direct supervision.

We reserve the right to decline any job at our discretion, including situations where the scope falls outside our expertise or where site conditions are unsafe.

Quotes and Pricing

All quotes are estimates based on information provided at the time of enquiry. Final pricing may vary if the scope of work changes on inspection or unforeseen complications arise. We will always communicate any price changes before proceeding with additional work.

Quotes are valid for 30 days from the date of issue unless otherwise stated. We reserve the right to adjust pricing after this period due to changes in parts, materials, or labour costs.

Payment Terms

Payment is due upon completion of work unless otherwise agreed in writing. For larger equipment installations, a deposit may be required before ordering parts. Accepted payment methods: bank transfer (EFT), cash, and card. Invoices not paid within 14 days may attract a late payment fee.

Warranty & Guarantee

Labour performed by Orca Pools WA is guaranteed for 30 days from completion against direct workmanship defects. If an issue attributable to our workmanship arises within this period, we will rectify it at no additional cost.

Parts and equipment are subject to the manufacturer's warranty. We will assist with any warranty claims on equipment we have supplied and installed.

Green pool recovery results may vary based on bloom severity, existing equipment condition, and compliance with post-treatment instructions. We cannot guarantee results where site conditions prevent full treatment protocols.

Customer Responsibilities

Customers must ensure safe and reasonable access to pool equipment and the property. Any existing conditions (cracked paving, unstable structures, undisclosed prior chemical treatments) that may affect the work must be disclosed before service commences.

Following a green pool treatment, customers must follow any post-treatment instructions provided. Failure to do so may affect results and void any satisfaction guarantee.

Limitation of Liability

To the extent permitted by Australian Consumer Law, our liability is limited to the value of the services provided. We are not responsible for indirect or consequential losses. This does not affect your rights under the Australian Consumer Law, which cannot be excluded.
